ExaSpark2. Accounts and beta access
You are responsible for accurate account information, credential security, authorized users, and activity under your account. Beta access may be limited, modified, suspended, or discontinued. Beta features may be incomplete, change without notice, or be subject to additional terms.
3. Acceptable use
You may not use ExaSpark to violate law or third-party rights; develop or distribute malware; gain unauthorized access; interfere with service integrity; evade usage limits; misrepresent generated content as verified fact where doing so may cause harm; or process regulated or highly sensitive data without written authorization and appropriate safeguards.
4. Your content
You retain ownership of content you submit. You grant ExaSpark a limited, worldwide license to host, reproduce, process, and display that content only as necessary to provide, secure, maintain, and improve the service and to comply with law. You are responsible for having the rights and permissions needed to submit content.
5. AI-generated output
Outputs may be inaccurate, incomplete, or similar to content generated for others. You are responsible for reviewing outputs before use and for decisions made from them. ExaSpark does not represent that output is unique, error-free, or suitable for legal, medical, financial, employment, or other high-impact decisions.
6. ExaSpark technology
ExaSpark and its licensors retain all rights in the service, software, models, interfaces, documentation, branding, and improvements, excluding your content. No rights are granted except as expressly stated in these Terms.
7. Third-party services
Integrations and third-party services are governed by their own terms and privacy practices. ExaSpark is not responsible for third-party services, but may suspend an integration where needed to protect users or service integrity.
8. Fees
Paid features, if offered, will be described in an order, plan, or checkout flow. Unless stated otherwise, fees are non-refundable except where required by law. Taxes, payment terms, renewals, and usage limits will be disclosed before purchase.
9. Confidentiality and feedback
Non-public beta materials may be confidential when identified as such or when their nature reasonably indicates confidentiality. If you provide feedback, ExaSpark may use it without restriction or compensation, while respecting any confidential information included in that feedback.
10. Suspension and termination
You may stop using the service at any time. ExaSpark may suspend or terminate access for breach, security risk, legal requirement, non-payment, or material harm to the service or other users. Provisions intended by their nature to survive will continue after termination.
11. Disclaimers
To the maximum extent permitted by law, the service and beta features are provided “as is” and “as available.” ExaSpark disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing.
12. Limitation of liability
To the maximum extent permitted by law, ExaSpark will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business opportunity. ExaSpark’s aggregate liability for claims relating to the service will not exceed amounts paid for the service during the twelve months before the event giving rise to liability, or USD 100 if no fees were paid.
13. General
These Terms, applicable order forms, and referenced policies form the entire agreement for the service. If a provision is unenforceable, the remaining provisions remain effective.
