1. Scope
This Policy applies to ExaSpark-controlled websites, applications, beta programs, support channels, and related services. It does not apply to third-party services governed by their own privacy terms.
2. Information we collect
We may collect account and contact details; workspace content and files you choose to provide; product usage, device, log, and diagnostic data; communications with ExaSpark; and billing or transaction metadata processed through authorized payment providers. We do not intentionally collect sensitive personal information unless it is necessary for a feature you choose to use and permitted by law.
3. How we use information
We use information to provide and secure the service, operate AI-assisted features, respond to requests, improve product quality, prevent abuse, meet legal obligations, and communicate material service updates. Where required, we rely on consent, performance of a contract, compliance with law, or our legitimate interests in operating a safe and useful service.
4. AI features and workspace content
Workspace content may be processed to perform the instructions you submit, generate requested outputs, maintain context within your workspace, and detect misuse. ExaSpark does not sell workspace content. Model providers and infrastructure vendors may process limited data solely to deliver contracted services, subject to appropriate safeguards and configuration.
5. Sharing and service providers
We may share information with vetted infrastructure, analytics, support, security, communications, and payment providers; professional advisers; authorities where legally required; and a successor in connection with a corporate transaction. Providers are authorized to process information only for defined business purposes.
6. Retention
We retain information for as long as needed to provide the service, fulfill the purposes described here, resolve disputes, enforce agreements, and comply with law. Retention periods vary by data type, account status, security requirements, and legal obligations.
7. Security
We use administrative, technical, and organizational measures designed to protect information, including access controls, encryption in transit, secure development practices, monitoring, and incident response procedures. No system is completely secure, and users remain responsible for protecting their credentials and configuring access appropriately.
8. International transfers
ExaSpark and its providers may process information in countries other than your own. Where required, we use recognized transfer mechanisms and contractual safeguards intended to protect personal information.
9. Your choices and rights
Depending on your location, you may have rights to access, correct, delete, restrict, object to, or export personal information, and to withdraw consent. Requests may be submitted to privacy@exaspark.ai. We may verify identity before completing a request.
11. Children
ExaSpark is not directed to children under the age required to consent to online services in their jurisdiction. We do not knowingly collect personal information from children in violation of applicable law.
12. Changes and contact
We may update this Policy to reflect product, legal, or operational changes. Material changes will be communicated through the service or other appropriate channel. Questions and requests may be sent to privacy@exaspark.ai.
